1. Introduction
Welcome to GlobalCommunityNews ("we," "us," or "our"). These Terms & Conditions ("Terms") dictate your usage of our yacht charter services and website at globalcommunitynews.sbs (the "Service") managed by GlobalCommunityNews.
By reserving a charter or using our Service, you consent to these Terms. Should you disagree with any section of these terms, you should refrain from using the Service.
2. Service Overview
GlobalCommunityNews offers elite yacht charter services, which include, but are not limited to:
- Day-long yacht rentals
- Evening boat trips
- Business retreats
- Exclusive events
- Extended charters
Our services are available according to vessel readiness and meteorological conditions. We maintain the authority to alter or cease services without notice.
3. Booking and Reservations
3.1 Booking Process
For a successful charter booking, you are required to:
- Be at least 18 years of age.
- Provide valid and comprehensive information.
- Submit the necessary deposit as indicated in your booking acknowledgement.
- Accept these Terms & Conditions.
3.2 Confirmation
A charter booking is considered confirmed upon the successful processing of your payment and our issuance of a confirmation in writing. We may refuse to provide service at our sole discretion.
3.3 Availability
All charters depend on the accessibility of the vessel and appropriate weather. We will seek to accommodate your requested dates and hours when possible.
4. Payment Terms
4.1 Pricing
All our costs are quoted in € and are inclusive of relevant taxes unless stated otherwise. Prices are subject to modification without prior notification.
4.2 Payment Schedule
- Initial deposit: 50% of the full charter fee payable during reservation.
- Final payment: Required to be settled 48 hours in advance of the charter departure.
- Any additional fees (as applicable): Payable after the charter has concluded.
4.3 Payment Methods
Payments are accepted through major credit cards, wire transfers, and certified cheques. Payments are processed securely using encrypted systems.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- If canceling more than 72 hours before departure: A full reimbursement minus service fees.
- For cancelations from 24 to 72 hours prior to departure: Half of the amount will be refunded.
- Cancellations less than 24 hours before departure: No refund will be issued.
5.2 Weather Cancellations
In case the captain deems weather conditions as unsafe, we will suggest:
- Rescheduling the charter to another available slot with no extra fee.
- Issuing a full refund where rescheduling is not feasible.
5.3 Mechanical Issues
If your charter yacht encounters mechanical issues, we will attempt to source an adequate replacement. If this isn't possible, we will provide a complete refund.
6. Safety and Conduct
6.1 Safety Requirements
All guests are expected to:
- Comply with all instructions from the crew.
- Use the safety gear as necessary.
- Disclose any medical conditions that could influence their safety.
- Stay within the allocated areas on board.
6.2 Prohibited Articles
The following items are forbidden on the yacht:
- Containers made of glass
- Illegal items
- Firearms or other weapons
- Excessive quantities of drinks (beyond reasonable consumption for sodas or lemonades)
- Pets (except if pre-sanctioned)
6.3 Behaviour
Passengers are required to behave cordially. We reserve the right to end a charter prematurely without any refund if passenger conduct endangers safety or disturbs other guests.
7. Liability and Insurance
7.1 Our Responsibility
We are accountable only to the extent of the charter cost paid. We are not liable for:
- Bodily harm due to guest negligence.
- The theft or damage of personal items.
- Any indirect, ensuing, or punitive damages.
- Delays caused by weather or other factors outside of our control.
7.2 Insurance
Our operations and vessels are insured under comprehensive marine insurance. Guests should ensure their travel and personal insurance coverage.
7.3 Acceptance of Risk
By taking part in our services, you recognize the inherent dangers associated with marine activities and accept accountability for your own security and welfare.
8. Changes to Itineraries and Schedules
Itineraries, paths, or timetables may be adjusted due to meteorological factors, safety issues, or operational necessities. We shall make all reasonable efforts to offer alternative experiences of comparable quality.
9. Force Majeure
We cannot be held accountable for any delays, cancellations, or changes brought about by forces beyond our control, which include but are not limited to:
- Extreme weather events
- Natural catastrophes
- Regulatory dictates
- Port shutdowns
- Vessel malfunctions
10. Privacy and Data Protection
We handle your personal data in adherence to our Privacy Policy. By engaging with our services, you consent to the gathering and utilization of your information as outlined in our Privacy Policy.
11. Intellectual Property
Content including but not limited to text, graphics, logos, and imagery on our website is copyrighted and must not be reproduced, distributed, or adapted without our explicit consent.
12. Governing Law
These Terms are subject to Monaco's laws. Any legal matters will be adjudicated in the courts of Monaco, Monaco.
13. Revisions to Terms
The right to amend these Terms at will is reserved by us. Amended versions will be published on our website with a notation of the date of amendment. The continued use of our services signifies agreement to any modified terms.
